Terms of Service

Welcome to CampEx. By accessing, downloading, or utilising our mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and the CampEx project and its administrators. If you do not agree to these Terms, you must immediately cease all use of the Service.

CampEx is a localised, community-driven digital marketplace designed specifically for the university student ecosystem. Our platform is intended to foster trust and sustainability within campus life.

Important: CampEx is a neutral venue. We do not inspect goods, handle payments, or ship items. All transactions are peer-to-peer and at your own risk.

1. The Nature of the Service (The "Venue" Clause)

1.1 Intermediary and Facilitator Status

CampEx acts strictly as a neutral digital venue and an information society service provider. Our role is limited to providing the technological infrastructure that enables verified students to discover goods and communicate with one another. We do not function as a retailer, auctioneer, or agent.

1.2 No Involvement in the Underlying Transaction

CampEx is not a party to any actual contract or transaction between buyers and sellers. We do not own, possess, inspect, verify, store, or ship any of the items listed on the Service. The "contract of sale" is formed directly between the student buyer and the student seller; CampEx has no rights or obligations under such contracts.

1.3 No Payment or Escrow Services

We do not facilitate payments, hold funds in escrow, or provide any financial clearing services. Any exchange of value—whether via Cash, EFT, Barter, or other means—occurs entirely outside of the Service. Users are solely responsible for verifying the receipt of funds and the authenticity of "Proof of Payment" documents provided by other users.

2. Eligibility, Verification, and Account Responsibility

  • 2.1 Verified Student Status: Access to the Service is a privilege restricted to currently enrolled university students. You must possess a valid, active university-issued email address (e.g., @sun.ac.za) to authenticate your account. You agree to provide accurate information and to update your account if your student status changes.
  • 2.2 Legal Capacity and Age: You must be at least 18 years of age and possess the full legal capacity to enter into binding contracts under South African law. By using the Service, you represent and warrant that you meet these eligibility requirements.
  • 2.3 Account Security and Liability: You are solely responsible for maintaining the confidentiality of your login credentials. You agree that any activity occurring under your "handle" or profile is your responsibility. You must notify support@campex.live immediately if you suspect any unauthorised access to your account.

3. User Conduct and Prohibited Items

3.1 Statutory and Institutional Compliance

Users must comply with all applicable laws of the Republic of South Africa, including the Consumer Protection Act and the Electronic Communications and Transactions Act, as well as their respective University's Code of Conduct and Academic Integrity policies.

3.2 Prohibited Items and Content

To maintain the integrity of the campus ecosystem, you are strictly prohibited from listing, selling, or purchasing:

  • Intellectual Property Infringements: Counterfeit goods, pirated software, or unauthorised copies of textbooks/e-books.
  • Academic Dishonesty Materials: Exam banks, solved past papers, pre-written assignments, or any materials intended to facilitate academic fraud.
  • Regulated Substances: Illegal drugs, prescription medications, alcohol, or tobacco products.
  • Dangerous Goods: Hazardous materials, weapons, or items that pose a threat to campus safety.
  • Stolen Property: Any items obtained through theft or unauthorised means.

3.3 Moderation and Safe Harbour

In accordance with Sections 73 to 75 of the ECTA, CampEx reserves the right, but not the obligation, to monitor content. We may remove any listing or suspend any account that, in our sole discretion, violates these Terms or threatens the safety and reputation of the student community.

4. Intellectual Property and Proprietary Rights

4.1 CampEx Ownership

The "CampEx" name, brand identity, logos, source code, database structures, and the proprietary algorithms powering the "AI Auto-Fill" system are the exclusive intellectual property of the CampEx founders. You may not copy, modify, or reverse-engineer any part of the Service.

4.2 AI-Generated Metadata

Our Service utilises AI to process your images and suggest listing metadata (such as titles and descriptions). While you retain ownership of your original photographs, the generated suggestions and the logic used to create them remain our property. By using the Service, you acknowledge that these suggestions are for convenience only and must be verified by you for accuracy.

4.3 User Licence Grant

By posting content (images and text) on CampEx, you grant us a non-exclusive, royalty-free, perpetual, and sub-licensable licence to use, display, modify, and reproduce such content for the purposes of operating, improving, and promoting the Service.

5. Disclaimers, "As-Is" Trading, and Limitation of Liability

5.1 The "As-Is" Mandate

The Service and all items discovered through it are provided on an "as-is" and "as-available" basis. CampEx makes no warranties of any kind, express or implied, regarding the condition, safety, legality, or merchantability of any listed items.

5.2 Physical Safety and the "Duty of Care"

ALL PHYSICAL MEETUPS, INSPECTIONS, AND EXCHANGES ARE CONDUCTED AT YOUR OWN RISK. CampEx is not liable for any physical harm, psychological distress, theft, or injury arising from interactions between users. To fulfill our commitment to community safety, we strongly recommend:

  • Meeting only in well-lit, high-traffic campus "Safe Zones" (e.g., The Neelsie or The Library).
  • Conducting trades during daylight hours.
  • Bringing a friend along for the exchange.

5.3 Liability Cap

To the maximum extent permitted by the Consumer Protection Act (CPA), CampEx, its founders, and affiliates shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from your use of the Service or the conduct of other users.

6. Disputes and "Caveat Emptor" (Buyer Beware)

6.1 Non-Intervention

Because CampEx does not handle payments or hold goods, we have no technical or legal mechanism to "reverse" a transaction or provide refunds. All sales are final between the parties.

6.2 Inspection Obligation

Buyers are urged to inspect items thoroughly before concluding a trade. Once a trade is completed and the buyer has left the meeting point, CampEx will not entertain any reports of "faulty" or "incorrect" items. We encourage users to use the in-app chat to document the agreed-upon condition of the goods prior to meeting.

7. Service Availability and "Force Majeure"

While we strive for 100% uptime, CampEx does not guarantee that the Service will always be available or error-free. You acknowledge that service may be interrupted due to maintenance, server failures, or external factors such as national grid instability (load shedding) affecting telecommunications. We are not responsible for the loss of any data or listing content resulting from technical failures or account deactivation.

8. Advertisements and Third-Party Links

You acknowledge that CampEx may display advertisements or sponsored listings within your product feed to sustain the Service. These will be clearly marked as "Sponsored" or "Ad" in accordance with Section 33 of the CPA. We do not endorse and are not responsible for the products, services, or privacy practices of third-party advertisers.

9. Termination of Service

We reserve the right to terminate, suspend, or restrict your access to the Service at our sole discretion, without notice or liability, for any reason, including but not limited to:

  • Breach of these Terms.
  • Behaving in a manner that brings the campus community into disrepute.
  • Extended periods of account inactivity.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts of South Africa (specifically the Western Cape Division, where applicable).
